Please read these Terms and Conditions ("Terms") carefully before using the Beardly mobile application ("the App").
1. Agreement to Terms
By accessing or using our App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
2. App Usage
2.1 The App provides personalized beard growth recommendations and tracking based on the information you provide. 2.2 You are responsible for maintaining the confidentiality of your account information and for all activities under your account. 2.3 You must not transmit any worms, viruses, or any code of a destructive nature.
3. Content & Accuracy
3.1 Beardly offers general beard care information and recommendations and is not intended as a substitute for professional medical advice. 3.2 The content, suggestions, and recommendations provided through the App are based on algorithms and general research, not personalized medical advice. 3.3 We strive for accuracy but make no guarantees regarding the effectiveness of recommendations for individual users.
4. Intellectual Property
4.1 The App and its original content, features, and functionality are owned by Anemoia Labs Ltd ("Beardly") and are protected by international copyright, trademark, and other intellectual property laws. 4.2 You may not duplicate, copy, or reuse any portion of the visual design elements or concepts without express written permission.
5. User Content
5.1 By uploading content (such as beard photos or progress information), you grant us a non-exclusive, royalty-free license to use, display, and store such content solely for the purpose of providing and improving our services. 5.2 You retain ownership rights to your content. 5.3 You are responsible for ensuring that your content does not violate any third-party rights.
6. Subscriptions & Payments
6.1 Some features of the App may require a subscription. 6.2 Subscription payments will be charged through your App Store account. 6.3 Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. 6.4 You can manage and cancel your subscriptions through your App Store account settings.
7. Limitation of Liability
7.1 Beardly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the App. 7.2 Our liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Beardly from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.
9. Third-Party Links
The App may contain links to third-party websites or services that are not owned or controlled by Beardly. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
10. Termination
10.1 We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. 10.2 Upon termination, your right to use the App will immediately cease.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. However, this will not deprive you of the protection afforded to you by mandatory provisions of the consumer protection laws in your country of residence. In other words, if the laws of your country of residence would grant you greater rights than our Terms, then such provisions of your local law shall apply. Any disputes arising under these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. We may still bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
